CLIENT will be charged in full when the order is placed. Other fees may be applied after payment due to damaged goods, loss of goods, or cleaning charges to items not including chinaware, flatware, glassware, and linens.
2. CANCELLATION POLICY
DifferRentals recognizes that plans can and do change, sometimes on short notice. If there is a change in CLIENT’S plans, (e.g. cancellation or postponement of the event) the CLIENT will take appropriate steps to book an alternative date (PENDING AVAILABILITY) and/or make other arrangements. In the event, however, the CLIENT is unable to do so, in whole or in part, DifferRentals will retain the 25% deposit as a store credit to be applied to any order within one (1) year (from the date of original event) only if the cancellation is made within 72 hours of the event. DifferRentals reserves the right to retain 100% of the total amount of order if not canceled 72 hours before the event.
a. TENT CANCELLATION POLICY
DifferRentals will retain a 25% deposit as a store credit to be applied to any order within one (1) year (from the date of the original event) if the cancellation is made before one (1) week of the event; however DifferRentals reserves the right to retain 100% of the total amount for any tent(s) cancelled less than one (1) week before the event.
3. ACTS OF NATURE
In the unlikely event of a DifferRentals’ cancellation or postponement of the event due to illness, disease, accident, or injury, DifferRentals reserves the right to find substitute staff, companies and/or subcontractors, to conduct/set-up the event. If DifferRentals is unable to conduct the event set forth in this agreement, DifferRentals may terminate this agreement and will refund all monies to the client and in lieu of any and all other damages of whatever kind and nature that might otherwise be available to the CLIENT under applicable law. In the event that it is impossible to hold the event, due to circumstances beyond the control of the parties, and the CLIENT is not reasonably able to book alternative events, DifferRentals reserves the right to charge or retain cost of un-returnable items, staff or any other expense purchased or prepared for the event.
4. ADDITIONAL FEES
a. CHAIRS: CLIENT shall clean and neatly stack chairs on tables prior to agreed upon date of pick-up, unless a gratuity charge arrangement has been made. If the CLIENT does not wish to do this, the CLIENT will pay an additional fee of $0.35 per chair.
b. RENTAL PERIOD (DELIVERED): DifferRentals rental period is a 12 HOUR DAY RENTAL; pick-up will be 12 hours after the delivery time. If the pick-up time falls after DifferRentals Store Hours (Monday – Friday 7AM – 5PM) the item(s) will be picked-up the following morning. If the CLIENT wishes to keep the rental items for additional time or same day pick-up, the CLIENT will pay an additional fee based upon availability and/or CLIENT location.
c. RENTAL PERIOD (CUSTOMER PICK-UP): DifferRentals rental period is as follows, pick-up of rental item(s) is between 9AM-5PM Monday through Friday and 9AM-1PM Saturday and Sunday. Returning of rental item(s) is at 8AM the following day. (i.e. Pick-up Saturday 11AM, drop off Sunday 8AM ~ Pick-up Monday 2PM, drop off Tuesday 8AM) Any items returned after 8:30am will be charged for an additional day item(s) rented.
d. DELIVERY: Delivery of rental items will be within a three (3) hour window, if the CLIENT needs delivery at a specific time, the CLIENT will pay an additional fee for this accommodation. CLIENT is responsible for counting items upon delivery/customer pick-up: otherwise amounts delivered will be considered correct. If items are found missing or damaged at pick-up/customer drop off, a detailed invoice of the charges will be provided to you following the event.
e. MOONWALK: All moonwalks are in clean condition prior to delivery/pick-up. Moonwalks must be returned clear of personal property and void of mud, grass, debris and/or food. DifferRentals is not responsible for any personal items left in the moonwalk. Cleaning fees may apply to moonwalks returned in unacceptable condition per discretion of DifferRentals.
f. TENTS: Due to possible smoke and fire damage, cooking, grilling, and or any open flames is NOT PERMITTED UNDER THE TENT at any time. TIKI TORCHES, FIREWORKS, SPARKLERS and SOURCES OF FIRE must be at least 30 feet from the tent at all times. NO COLORED STREAMERS or TAPE on the tent or tent sides due to staining. If applicable, tent sides must be kept hanging on tent or folded and STORED DRY AND CLEAN (do not place on ground). All lighting, cooking, heating sources or decorations (e.g. colored streamers are NOT allowed) used in the vicinity of DifferRentals tents must be approved by DifferRentals in advance. CLIENT agrees to reimburse DifferRentals for any and all costs resulting from damages due to use of lighting, cooking, heating equipment, or decorations except if previously authorized by DifferRentals. In the event of serious damage, DifferRentals reserves the right to repair or replace the damaged tent at its discretion, at the CLIENTS sole expense.
g. LINENS: CLIENT is responsible for table set-up (e.g. putting tablecloths on tables, folding napkins, etc) unless previous arrangements have been made with DifferRentals and an additional fee has been applied. Following the event, and prior to agreed upon time of pick-up, the CLIENT will shake food and debris from all table clothes and napkins and place them in the green laundry bag provided or in the unlikely event bags are not provided, in clean, cardboard boxes. Linens should not be placed in plastic bags or containers of any kind. For damages beyond normal wear (e.g. cigarette burns, sparkler burns, excessive candle wax, linens used as cleaning cloths) the CLIENT will pay an additional fee per linen.
h. TABLEWARE: All tableware is delivered in handling racks. All tableware is delivered clean, sanitized, wrapped in plastic and ready to set. Following the event, and prior to agreed upon time of pick-up, the CLIENT will clear all tableware of food matter, rinse (hosed off is fine), dry, and return to the handling racks in which they were delivered. Failure to do so will result in an additional surcharge. CLIENT agrees to pay additional fee (per item) for any missing or damaged items.
i. MOONWALK SET-UP: A set-up fee of $15.00 is applied to any Moonwalks delivered and set-up by DifferRentals Event Team.
j. SITE PREPARATION: If the site is not properly ready or accessible when the Event Team arrives (i.e. lawns mowed, vehicles/obstacles out of the way), or if rental items cannot be dropped directly on site (extra handling involved) the CLIENT will pay an additional fee.
k. PERMITS: CLIENT is responsible for any permits needed for tents, moonwalks, etc. In the event the CLIENT is unable to obtain a permit for any reason DifferRentals will be more then willing to do so at the CLIENT’S expense.
5. ONLINE ORDERING
a. ONE COUPON PER ITEM, PER ORDER
You are allowed to use one coupon, per item in your order. If the system accepts more than one coupon per item, you will be charged the difference.
b. REAL-TIME AVAILABILITY
Our online ordering system is not 100% real-time. In the event that your item(s) are not available, we will do our best to find you a substitute, or refund the items which are not available.
6. MOONWALKS (If applicable)
Play on a moonwalk/amusement device/inflatable entails both known and unknown risks including, but not limited to, physical injury from falling, slipping, crashing or colliding, emotional injury, paralysis, distress, damage or death to any participant. I, hereby voluntarily and expressly release, indemnify, forever discharge and hold harmless DifferRentals LLC from any liability, claims, demands, causes or rights of action weather personal to me or to a third party, which are in any way connected with participation in this activity, including those allegedly attributable to negligent acts or omissions. Should DifferRentals or anyone acting on my behalf of DifferRentals be required to incur attorney’s fees and costs to enforce this agreement, I expressly agree to indemnify and hold DifferRentals harmless for all such fees and costs. In the event I, the undersigned or any of my participants file a lawsuit against DifferRentals, it is agreed to do so solely in the state of Massachusetts. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. In consideration of being permitted by DifferRentals to use its equipment, the undersigned and its participants agree to indemnify and hold harmless DifferRentals from any and all claims which are brought by the undersigned and/or their participants and which are in any way connected with such use or participation.
A set of RULES AND DIRECTIONS are displayed on the moonwalk/amusement device/inflatable(s) which I agree to follow and utilized at all times during operation and use of the unit(s).
7. DAMAGE WAIVER (If applicable)
In order to provide a worry-free rental, DifferRentals LLC offers an optional Damage Waiver of 10%-20% (depending on items rented) of the rental amount. The Damage Waiver protects the customer from the unforeseen cost of repairing accidental damage to the rental items. The Damage Waiver is automatically calculated into the rental invoice. It is non-refundable. With acceptance of the Damage Waiver, the customer will not be required to pay any and all expenses of the damaged items up to the full cost of such items if purchased new. The Damage Waiver DOES NOT cover any loss or damage due to theft, misuse or abuse, unexplained loss, theft by conversion, unsecured items, or any loss due to the customer negligence for the rental items with disregard to reasonable care of such items.
The Damage Waiver can be declined by the CLIENT, however, DifferRentals reserves the right to repair or replace any and all damaged rental items at the CLIENTS sole expense.
